Puppy/Dog is being sold based on the quality the Seller feels this puppy/dog is at time of sale.  Seller does not and can not guarantee the show quality of this puppy/dog, or how this puppy/dog will grow and mature, to include size, color, or temperament.

Puppy/Dog will be checked by Seller’s Veterinarian before leaving and is to the best of the Seller’s knowledge in a healthy and sound state at time of sale. Sire and Dam are current on CERF certification, are in excellent health with no Genetic Defects, and have solid Genetic Histories.

Buyer understands and agrees that puppies sold with Limited AKC Registration must be spayed/neutered prior to one year of age, and provide Seller proof of this procedure.  If Buyer decides at a later date that they would like to have this changed to a Full Registration, prior to spay/neuter, they must contact the Seller to discuss the reason for this request.  The Seller will then determine if the puppy is of correct temperament and health, and meets the AKC conformation standard for the Havanese breed.  If the Seller feels for ANY reason that this puppy should not be given Full Registration, the Buyer agrees to have the puppy spayed/neutered.  The Seller requires an additional fee to transfer to Full Registration.

Under no circumstances will the Seller be held responsible for any veterinary expenses incurred by the Buyer at any time for any reason for this puppy/dog.

Buyer will not resell, lease out, trade or give this puppy/dog to any person for the purpose of breeding.

Buyer will not surrender puppy/dog to any research facility, pet shop, humane society, rescue group or similar facility.

Buyer agrees to contact Seller if Buyer can no longer keep or care for puppy/dog.

Buyer agrees to keep puppy/dog up to date on recommended vaccinations and veterinary checkups.

Buyer agrees to have puppy Microchipped within 90 days after taking possession of puppy to comply with the Warranty-Sale Terms, and mail or e-mail Microchip Number to seller.  Should this not be done, the entire Warranty & Guarantee, as stated in this contract, is void.  No exceptions.

Two Year Genetic Replacement Warranty: If during the first 24 months your Veterinarian has determined that your Puppy has a Disabling Genetic Defect, and Seller is provided with written documentation and test results, upon return of the Puppy at Buyers expense, Seller will provide a replacement Puppy as soon as one becomes available.

Warranty does not include replacement of puppy for color changes, tear staining, size, teeth alignment, general health,
temperament, or cosmetic issues.

Excelsior’s Havanese Puppies Health Guarantee: Buyer has 3 business days upon taking possession to have the puppy/dog examined by your Veterinarian and have the Veterinarian Examination Form filled out by your Vet, and
mailed or e-mailed back to Excelsior’s Havanese Puppies within 14 days.  If during this examination your puppy/dog is found to have a preexisting Genetic Health Condition not found during our Veterinarian’s examination, and Seller is provided with written documentation and test results, upon return of the puppy/dog at Buyers expense, we will refund purchase price of the puppy/dog or provide a replacement puppy/dog as soon as one becomes available, whichever Buyer prefers. 

BY SIGNING THIS CONTRACT BUYER VERIFIES THAT HE/SHE HAS READ THIS CONTRACT AND UNDERSTANDS IT’S CONTENTS AND AGREES TO ABIDE BY ALL TERMS AND CONDITIONS OF THIS CONTRACT.  FAILURE TO COMPLY WILL VOID ENTIRE WARRANTY AND CONTRACT.
